Rule 15
WRITING FOR DEPARTMENTAL ACTION
(1) According to the report received by the Commission in accordance with Rule 8 or 10, if the person who commits the acts mentioned in Section D of the Act is an existing employee of the civil service, other government service or an institution or body owned by the Government of Nepal, action will be taken according to the law related to his service conditions, for departmental action. A copy of the report should be sent to the concerned officer.
(2) If a written report is sent from the commission for action as per sub-rule (1), within seven days from the date of receipt of the report, the officer authorized to take departmental action against the concerned employee shall express any opinion and reaction on the report: If necessary, departmental action may be taken against such employee. or cannot be submitted to the Commission including the following subjects:-
(a) whether or not to accept the report in whole or in part,
(b) whether or not any action has been taken in connection with the assault or if action has been taken, the details of the action,
(c) If the report is not to be accepted in whole or in part, the reason and basis thereof. (3) If the response is not received from such officer within the time limit as per sub-rule (2), the Secretary of the Commission shall address the matter and make another inquiry within seven days.
(4) In connection with the investigation in accordance with this rule, the Secretary shall submit the matter to the Commission after the reply received from the authority authorized to take departmental action pursuant to sub-rule (2) or after the period for which the reply should have been received has passed.
